Registration of Trade Unions

Registration is the process by which a trade union acquires legal personality, statutory immunities, and the capacity to represent workers in formal proceedings.

Application Requirements (S.5)

An application for registration must be accompanied by:

Mandatory Rules (S.6)

Every registered trade union's constitution MUST contain provisions on:

  1. Name of the union
  2. Whole of the objects for which it is established
  3. Whole of the purposes for which general funds may be applied
  4. Maintenance of list of members and adequate facilities for inspection
  5. Admission of ordinary members (age requirement: completed 14 years for workers in trade)
  6. Conditions under which members enjoy benefits and impose fines
  7. Manner of making, altering, and rescinding rules
  8. Manner of appointment and removal of executive and other office-bearers
  9. Safe custody of funds, annual audit, and adequate facilities for inspection of account books
  10. Manner of dissolution

Why: These mandatory rules ensure internal democracy, financial accountability, and transparency. Without them, union leaders could act without member consent, misuse funds, or operate without accountability. The law imposes governance standards as the price of registration.

Why: The 10% threshold is a major IRC 2020 change. Under the old TUA, any 7 workers could register a union regardless of total workforce size. This led to "pocket unions" with 7-10 members claiming to represent thousands. The 10% requirement ensures registered unions have genuine representative character.

Certificate of Registration (S.8)

The certificate of registration is conclusive evidence that the trade union has been duly registered. Upon registration, the union becomes a body corporate with:

  • Perpetual succession
  • Common seal
  • Power to acquire and hold property (movable and immovable)
  • Capacity to contract
  • Capacity to sue and be sued

Cancellation of Registration (S.9)

The Registrar may withdraw or cancel registration if:

Safeguards:

  • Registrar must give union not less than 2 months' notice before cancellation
  • Union has opportunity to show cause
  • Appeal lies to appropriate High Court (S.10)

Why: Cancellation power prevents dead or fraudulent unions from enjoying statutory privileges. But the 2-month notice and appeal rights protect genuine unions from arbitrary executive action.

Illustrations

  1. The "pocket union" problem: In a factory with 2,000 workers, the employer's HR manager encourages 7 loyalist workers to register "ABC Workers Union." Under TUA 1926, registration was granted (7 members sufficient). This sham union then "represented" workers in settlements favourable to management. Under IRC 2020, this union needs 100 members minimum (10% of 2,000 = 200, or 100, whichever is less). The 7-member shell cannot register. The reform targets exactly this abuse.

  2. Registration vs. refusal: Raj and 10 co-workers at a garment factory apply to register "Garment Workers' Solidarity Union." The Registrar finds: (a) the constitution has no provision for annual audit, (b) no procedure for removal of office-bearers. The Registrar calls for information under S.7 and directs amendments. Raj amends the constitution, resubmits. The Registrar, now satisfied, issues a certificate under S.8. The union is a body corporate from the date of certificate.

  3. Cancellation scenario: "Delhi Transport Workers Union" was registered in 2021 with 150 members (out of 1,000 workers: 15%). By 2024, membership drops to 40 (4%). The Registrar issues 2-month notice for cancellation under S.9. The union holds a recruitment drive and presents 120 membership forms at the show-cause hearing. If verified, cancellation is averted. If the forms are fraudulent, cancellation proceeds with appeal rights to High Court.
